1. Introduction

Homagni ("Homagni", "we", "us", "our") is a brand of Rajlakshmi Jewellers, a proprietorship owned by Sri Tapan Dey ("Proprietor"), having its registered office and store at 212, Rashbehari Avenue, 1st Floor, Shop No. CD 104, Gariahat KMC Market, Kolkata – 700019, West Bengal, India.

These Terms & Conditions ("Terms") govern your access to and use of the website www.homagni.com, our official social media storefronts, and our physical store (collectively, the "Platform"), and your purchase of any silver jewellery or related products ("Products") offered by us.

By accessing or using the Platform, placing an order, or transacting with us in any manner — online or in-store — you ("User", "you", "your") agree to be bound by these Terms, our Privacy Policy, Shipping Policy, Cancellation, Return, Refund & Exchange Policy, Buyback & Exchange Policy, and Payment Policy, each of which is incorporated herein by reference. If you do not agree to these Terms, please do not use the Platform.

2. Eligibility

You must be at least 18 years of age, or transacting under the supervision of a parent or legal guardian, to use the Platform or place an order. By using the Platform, you represent that you are competent to enter into a legally binding contract under the Indian Contract Act, 1872, or the equivalent law of your country of residence.

We currently accept orders from customers located in India as well as select international destinations, subject to the shipping availability and terms set out in our Shipping Policy.

3. Account & User Responsibilities

Where registration is required to place an order, you agree to:

  • provide true, accurate, current, and complete information about yourself;
  • maintain and promptly update such information;
  • keep your account credentials confidential and be responsible for all activity under your account.

We reserve the right to suspend or terminate any account where information provided is found to be false, inaccurate, or in violation of these Terms.

4. Products, Pricing & Hallmarking

  • All Homagni silver jewellery is BIS Hallmarked 925 Sterling Silver, certifying the purity of the metal in accordance with Bureau of Indian Standards norms.
  • Products are largely handcrafted. Minor variations in weight, finish, or design of up to ±10% from the displayed specification may occur and do not constitute a defect.
  • Product images are for reference; actual colour, size, and finish may vary slightly due to photography, lighting, or display settings.
  • Prices are subject to change without prior notice, including due to fluctuations in silver rates. The price applicable is the price displayed on the Platform at the time your order is confirmed.
  • We reserve the right to modify, discontinue, or limit the quantity of any Product at our sole discretion.

5. Orders

  • An order is placed by adding a Product to your cart and completing checkout on the website, or by placing an order through our official WhatsApp number or social media storefronts.
  • An order is confirmed only once full payment (or, for Cash on Delivery orders, the order itself) has been acknowledged by us.
  • We reserve the right to cancel any order at our sole discretion in cases of pricing errors, stock unavailability, suspected fraud, or inability to verify the order/customer, in which case any amount paid shall be refunded in full.
  • As required under applicable law, orders above ₹2,00,000 in value may require the customer to furnish PAN details before dispatch.

6. Payments

We accept payments via our secure payment gateway partner, Razorpay, including credit/debit cards, UPI, and net banking. Cash on Delivery (COD) is available for eligible domestic orders. Full details are set out in our Payment Policy.

7. Shipping & Delivery

Shipping timelines, charges, and courier partners for domestic and international orders are set out in our Shipping Policy. International shipping charges vary by destination country and are communicated at checkout.

8. Cancellations, Returns, Refunds & Exchanges

Cancellation, return, refund, and exchange terms — including applicable time windows and eligibility conditions — are set out in our Cancellation, Return, Refund & Exchange Policy. Our lifetime buyback and exchange terms for silver jewellery are set out separately in our Buyback & Exchange Policy.

9. Intellectual Property

All content on the Platform — including the Homagni name, logo, product designs, photographs, and written content — is the property of Rajlakshmi Jewellers / Homagni or its licensors and is protected under applicable intellectual property law. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.

10. Prohibited Uses

You agree not to use the Platform to:

  • violate any applicable law or regulation;
  • transmit any virus, malware, or harmful code;
  • impersonate any person or misrepresent your affiliation;
  • scrape, harvest, or collect data about other users;
  • interfere with the security or proper functioning of the Platform.

We reserve the right to terminate access for any User found in breach of the above.

11. Third-Party Links & Tools

The Platform may contain links to third-party websites or make use of third-party tools (including our payment and logistics partners). We do not control and are not responsible for the content, policies, or practices of such third parties. Use of any third-party service is at your own risk.

12. Disclaimer of Warranties

The Platform and Products are provided on an "as is" and "as available" basis. While we take reasonable care to ensure accuracy of information and quality of Products, we do not warrant that the Platform will be error-free or uninterrupted, or that Product images will be identical in every respect to the delivered Product.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Homagni and Rajlakshmi Jewellers shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or Products, beyond the value of the Product actually purchased.

14. Indemnification

You agree to indemnify and hold harmless Homagni, Rajlakshmi Jewellers, its Proprietor, and its employees from any claim or demand arising out of your breach of these Terms or your violation of any law or third-party right.

15. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.

17. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, the name and contact details of our Grievance Officer are published below and in our Grievance Redressal Policy.

18. Modifications to These Terms

We reserve the right to update, modify, or replace any part of these Terms at any time. Continued use of the Platform after any such change constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
